CHAPTER 7

LEGAL TERMS

CLAT Legal Reasoning

1. Legal Term

2. Plaintiff और Defendant

Plaintiff

Defendant

Plaintiff

Defendant

Plaintiff
Defendant

3. Complainant

4. Accused

Accused

5. Victim

6. Conviction

Convicted

Conviction

Conviction = दोषसिद्धि

7. Acquittal

Acquittal

Acquittal = दोषमुक्ति

8. Bail

Bail

9. Arrest

Arrest

Arrest → custody
Trial → case की judicial examination
Conviction → guilty

10. Custody

Police Custody

Judicial Custody

11. FIR

First Information Report

12. Investigation

Investigation

13. Evidence

  • Oral evidence
  • Documentary evidence
  • Electronic evidence
  • Physical/material evidence

14. Witness

15. Testimony

Testimony

16. Affidavit

17. Summons

Summons

18. Warrant

Arrest warrant

19. Jurisdiction

  • Territorial jurisdiction
  • Subject-matter jurisdiction
  • Pecuniary jurisdiction

Jurisdiction = किसी court/authority की कानूनी सीमा और power

20. Appeal

Appeal

21. Revision

22. Review

23. Judgment

24. Order

25. Decree

26. Litigation

Litigation

27. Dispute

28. Liability

यदि A ने negligence के कारण B को नुकसान पहुँचाया और applicable law के अनुसार A legally responsible है, तो कहा जा सकता है कि A पर liability हो सकती है।

Liability = legal responsibility

29. Negligence

क्या उसने reasonable standard of care breach किया?

30. Damages

Damages

31. Compensation

Compensation का अर्थ broadly किसी loss, injury या harm के लिए दिया जाने वाला monetary or other legal redress हो सकता है।

32. Remedy

Remedy

Ubi jus ibi remedium

33. Injunction

Injunction = court का रोकने या निर्देश देने वाला order

34. Specific Performance

मान लीजिए A ने B से एक particular property बेचने का valid agreement किया लेकिन बाद में A contract perform करने से मना कर देता है।

Specific Performance

35. Breach

A और B के बीच agreement हुआ कि A 10 तारीख को goods deliver करेगा।

A बिना lawful justification के goods deliver नहीं करता।

36. Contract

37. Agreement

Every contract is an agreement, but every agreement is not necessarily a contract.

38. Consideration

सरल भाषा में इसे किसी promise के बदले मिलने वाला something of value / legal value समझा जा सकता है, subject to applicable law.

A कहता है:

39. Consent

40. Coercion

Coercion

A, B को धमकी देता है कि यदि B agreement sign नहीं करेगा तो A उसे serious harm पहुँचाएगा।

41. Undue Influence

Undue Influence

42. Fraud

43. Misrepresentation

44. Void

Void = legally ineffective / unenforceable

45. Voidable

उदाहरण के लिए certain circumstances involving coercion, fraud or undue influence में contract voidable हो सकता है।

46. Valid

47. Illegal

48. Tort

49. Nuisance

50. Defamation

Defamation

Libel – generally written/published defamatory statement.

Slander – traditionally spoken defamatory statement.

51. Libel

Libel traditionally written or permanent-form defamatory publication

A ने B के बारे में newspaper में knowingly false defamatory statement publish किया।

52. Slander

Slander traditionally spoken defamatory statement

A ने public gathering में B के बारे में false defamatory statement बोला।

53. Negligence

Court

54. Causation

Causation

A ने negligent driving की।

क्या A की negligence और B की injury के बीच legally sufficient causal connection है?

55. Mens Rea

Mens rea का अर्थ broadly guilty mind या criminal intention/state of mind से है।

इसी कारण criminal law में mens rea महत्वपूर्ण हो सकती है, subject to the specific offence and statutory requirements.

56. Actus Reus

Actus reus broadly criminal act or conduct को refer करता है।

Actus reus = guilty act

और:

Mens rea = guilty mind

57. Alibi

Alibi

Elsewhere

58. Accomplice

B की legal position accomplice के concept से जुड़ सकती है, depending on applicable law.

59. Accessory

60. Principal

61. Abetment

62. Conspiracy

63. Jurisprudence

  • Law
  • Law
  • Justice
  • Rights

64. Justice

65. Equity

Equity broadly fairness-based legal principles

जब strict application of a rule से unfairness का question उठे, तो equity के principles historically important रहे हैं।

66. Precedent

Precedent

Applicable doctrine of precedent

67. Ratio Decidendi

Ratio = decision का legal reason/principle

68. Obiter Dicta

69. Stare Decisis

70. Per Incuriam

Per incuriam

Through lack of proper regard for the relevant law.

71. Sine Qua Non

Sine qua non

Without which

72. Prima Facie

Prima facie

At first sight / on the face of it

73. Bona Fide

Bona fide

In good faith

74. Mala Fide

Mala fide

In bad faith

75. Amicus Curiae

Amicus curiae

Friend of the Court

76. Habeas Corpus

77. Injunction

Injunction = court द्वारा restraint या direction

78. Habeas Corpus, Mandamus, Certiorari, Prohibition और Quo Warranto

Habeas Corpus

Mandamus

Certiorari

Prohibition

Quo Warranto

79. De Facto

De facto

In fact /

80. De Jure

De jure

According to law /

De facto = actually

De jure = legally

81. Ex Parte

यह ex parte proceeding/order हो सकता है।

82. Ex Gratia

Ex gratia

As a matter of grace/favour

83. In Camera

Sensitive matter में court public access restrict करके proceeding in camera कर सकती है।

84. In Situ

In situ

In its original place

85. In Personam

In personam

Against a particular person

जब legal right या order किसी specific person के संबंध में हो, तो उसे in personam कहा जा सकता है।

86. In Rem

In rem

Against or concerning a thing/right generally

In personam → particular person

In rem → right/status against the world generally / thing-related context

87. Ipso Facto

Ipso facto

By the fact itself

88. Locus Standi

Locus standi

89. Modus Operandi

Modus operandi

Method of operation

90. Ultra Vires

Ultra vires

Beyond the legal power or authority

91. Intra Vires

Intra vires

Within legal power or authority

92. Suo Motu

Suo motu

On its own motion

93. Status Quo

Status quo

Existing state of affairs

94. Quantum Meruit

Quantum meruit का अर्थ broadly:

As much as is deserved / reasonable amount earned

A ने contract के तहत कुछ work complete किया लेकिन circumstances के कारण पूरा contract complete नहीं हुआ।

95. Res Judicata

96. Res Ipsa Loquitur

Res ipsa loquitur

The thing speaks for itself

97. Respondeat Superior

Respondeat superior का अर्थ broadly:

Let the superior answer

98. Qui Facit Per Alium Facit Per Se

He who acts through another acts himself.

Certain circumstances में B का act A से legally attributable हो सकता है।

99. Delegatus Non Potest Delegare

A delegate cannot further delegate

100. Nemo Judex In Causa Sua

No one should be a judge in his own cause.

101. Audi Alteram Partem

Hear the other side.

102. Caveat Emptor

Caveat emptor

Let the buyer beware.

103. Caveat Venditor

Caveat venditor

Let the seller beware.

104. Nemo Dat Quod Non Habet

No one gives what he does not have.

इसलिए CLAT में “Nemo dat = absolutely no exception” नहीं मानना चाहिए।

105. Ignorantia Juris Non Excusat

Ignorance of law is no excuse.

सरल example:

A कहता है:

106. Ignorantia Facti Excusat

इसका अर्थ broadly:

Ignorance of fact may excuse.

107. Actus Non Facit Reum Nisi Mens Sit Rea

An act does not make a person guilty unless there is a guilty mind.

108. Volenti Non Fit Injuria

इसका अर्थ broadly:

To one who voluntarily consents, no injury is done.

लेकिन mere knowledge of risk हमेशा sufficient नहीं है।

109. Ubi Jus Ibi Remedium

Where there is a right, there is a remedy.

110. Damnum Sine Injuria

Damage without legal injury.

111. Injuria Sine Damno

Legal injury without actual damage.

112. Dura Lex Sed Lex

The law is harsh, but it is the law.

113. Generalia Specialibus Non Derogant

General provisions do not normally override specific provisions.

114. Bona Vacantia

Bona vacantia का अर्थ broadly:

Ownerless goods/property

115. Corpus Delicti

Body or substance of the offence

116. Res Gestae

117. Res Nullius

Res nullius

Thing belonging to nobody

118. Res Integra

A matter not previously settled or decided

119. Qui Prior Est Tempore Potior Est Jure

He who is earlier in time is stronger in right.

कई legal contexts में पहले created/registered/established right को priority मिल सकती है, subject to applicable law and exceptions.

120. Qui Sentit Commodum Debet Et Sentire Onus

इसका basic idea है:

He who receives the benefit should also bear the burden.

121. Qui Tacet Consentire Videtur

इसका traditional meaning है:

He who is silent is considered to consent.

लेकिन modern law में silence does not automatically mean consent.

122. Actio PersonalIs Moritur Cum Persona

A personal action dies with the person.

कई personal claims की survival या succession applicable statutes और nature of claim पर depend करती है।

123. Ab Initio

Ab initio

From the beginning

124. Ad Hoc

Ad hoc

For a particular purpose

125. Ad Litem

Ad litem का अर्थ broadly:

For the purpose of the litigation

किसी minor या person unable to represent themselves के interests को particular litigation में represent करने के लिए legal representative/guardian appointed हो सकता है।

Situation 1

→ Bona fide

Situation 2

Bona fide = good faith

Mala fide = bad faith

De facto

De jure

128. In Personam और In Rem

In personam

In rem

Void

Voidable

130. Plaintiff, Defendant और Accused

Civil Case

Plaintiff
Defendant

Criminal Case

Accused

131. Acquittal और Conviction

Criminal trial

→ Conviction

→ Acquittal

Bail ≠ Acquittal

132. Appeal, Review और Revision

Appeal

Review

Same court अपने judgment को legally recognized grounds पर फिर examine करती है।

Revision

133. Legal Terms

A court has the authority to hear a dispute because the case falls within its legally prescribed territorial limits.

Answer

Jurisdiction

A person was physically present in another city when the crime occurred.

Alibi

The court prevented a party from taking a particular action.

तो:

Injunction

The court observed that an earlier judgment was not based on a necessary legal reason.

Direct Meaning

What does “bona fide” mean?

Answer:

In good faith

Situation Based

Question:

Answer:

Bona fide

Legal Relationship Based

Question:

Answer:

Stare decisis

Procedural Situation

Question:

Answer:

Habeas corpus

Authority Based

Question:

Answer:

Ultra vires

Shop owner complainant/victim हो सकता है, depending on procedural context.

Trial

Prosecution evidence

Accused → Complainant → Victim → Investigation → Evidence → Witness → Arrest → Custody → Bail → Trial → Alibi → Conviction → Acquittal → Appeal

Legal Vocabulary

Natural Justice

Student

Nemo judex in causa sua

Term

“The authority acted beyond the power granted to it.”

“The accused was somewhere else when the offence occurred.”

“The court should hear the person before passing an adverse decision.”

“The decision-maker has a personal interest in the matter.”

आपको Nemo Judex in Causa Sua का concept दिखाई देना चाहिए।

“The matter has already been finally decided between the same parties.”

“The authority has taken the action on its own initiative.”

“The act was beyond the legal authority.”

“The person honestly and genuinely acted without bad faith.”

140. Chapter 7

Conviction

Acquittal

Jurisdiction court की legal power है।

Liability legal responsibility है।

Remedy legal relief

Mens rea mental element

Actus reus prohibited act/conduct

Bona fide good faith है।

Mala fide bad faith है।

Prima facie

Obiter dicta non-essential judicial observations
