Simple Example

Every rule is not necessarily a Law.

1. Social Order

2. Rights की Protection

  • Property Rights
  • Contractual Rights
  • Constitutional Rights

3. Duties

4. Disputes का Resolution

6. Justice का Administration

CLAT Concept

1.3 IMPORTANT DEFINITIONS OF LAW

“Command of the Sovereign backed by sanction”

Simple language

Elements

Command + Duty + Sanction

Memory Trick

AUSTIN = COMMAND + SOVEREIGN + SANCTION

Example

CLAT Trap

Simple idea:

Law = State द्वारा recognised and applied principles connected with administration of justice.

Exam Memory

Austin → Command

Salmond → State-recognised principles + Justice

1.5 CHARACTERISTICS OF LAW

1. Law is a Rule of Conduct

2. Law is Recognised by the State

3. Law Creates Rights and Duties

Example

A ने B को legally valid loan दिया।

B पर repayment की legal obligation हो सकती है और A को corresponding legal right मिल सकता है।

4. Law is Enforceable

Possible consequences

  • Fine
  • Compensation
  • Imprisonment
  • Injunction
  • Other legal remedies

5. Law Changes with Society

Law completely static

6. Law Helps Maintain Order

1.6 NATURE OF LAW

  • Normative
  • Social
  • Regulatory
  • Dynamic
  • Enforceable
  • Institutional
  • General in application
  • Connected with justice and social order

1.6.1 LAW IS NORMATIVE

Example

“Drivers must follow traffic rules.”

1.6.2 LAW IS SOCIAL

Law society

1.6.3 LAW IS REGULATORY

  • Business Regulation
  • Traffic Regulation
  • Environmental Regulation
  • Employment Regulation

1.6.4 LAW IS DYNAMIC

CLAT Tip

“Law never changes.”

1.6.5 LAW IS ENFORCEABLE

LAW

  • Legal system द्वारा recognised
  • Legally enforceable

MORALITY

  • Right और wrong की ethical understanding

Example

Immoral ≠ Always Illegal

और

Illegal ≠ Simply Immoral

CLAT Golden Rule

1.8 CLASSIFICATION OF LAW

  1. Imperative Law
  2. Natural or Moral Law
  3. Conventional Law
  4. Civil Law
  5. Criminal Law
  6. Public Law
  7. Private Law
  8. Substantive Law
  9. Procedural Law
  10. Domestic Law
  11. International Law

1.9 IMPERATIVE LAW

Simple Meaning

Imperative = Mandatory / Command

Example

CLAT Memory

Imperative Law → Command / Mandatory Requirement

1.10 PHYSICAL OR SCIENTIFIC LAW

Physical या Scientific Laws human-made legal rules नहीं होते।

  • Law of Gravity
  • Scientific Laws
  • Physical Principles

Important CLAT Trap

Law of Gravity और Law made by Parliament एक ही प्रकार के Law नहीं हैं।

Legal Law → Human society के legal rules

1.11 PRACTICAL OR TECHNICAL LAW

CLAT Tip

1.12 NATURAL OR MORAL LAW

Natural Law theory broadly यह मानती है कि कुछ fundamental principles of justice और right and wrong human nature, reason या morality से derive किए जा सकते हैं।

Simple language

Examples

  • Justice
  • Fairness
  • Basic moral principles

CLAT Trap

1.13 CONVENTIONAL LAW

Memory Trick

Convention → Agreement / Accepted Practice

1.14 CIVIL LAW

Examples

  • Contract disputes
  • Property disputes
  • Compensation claims
  • Civil wrongs

Main Focus

Civil matters में remedies, compensation और enforcement of rights important हो सकते हैं।

1.15 CRIMINAL LAW

Examples

  • Theft
  • Murder
  • Assault
  • Certain forms of fraud

Main Focus

Criminal justice system में punishment, deterrence और protection of society important objectives हैं।

1.16 CIVIL LAW vs CRIMINAL LAW

Civil Law Criminal Law
Private rights/disputes से related Offences से related
Compensation/remedy important Punishment important
Contract/property disputes Theft/murder आदि
Private parties often involved State prosecution generally involved

Important CLAT Trap

1.17 PUBLIC LAW

Public Law State, public institutions

Examples

  • Constitutional Law
  • Administrative Law
  • Criminal Law

Memory

PUBLIC LAW → STATE + PUBLIC POWER

1.18 PRIVATE LAW

Examples

  • Contract Law
  • Property Law
  • Family Law
  • Law of Torts

Memory

PRIVATE LAW → PRIVATE RELATIONSHIPS

1.19 PUBLIC LAW vs PRIVATE LAW

Public Law Private Law
State/public power से related Private persons/entities से related
Public interest/institutions important Private rights and obligations important
Constitutional Law Contract Law
Administrative Law Property Law
Criminal Law Family Law

1.20 SUBSTANTIVE LAW

Substantive Law

Simple Formula

SUBSTANTIVE = WHAT

Example

1.21 PROCEDURAL LAW

Simple Formula

PROCEDURAL = HOW

Example

  • Court procedure
  • Filing procedure
  • Trial procedure
  • Procedural rules

1.22 SUBSTANTIVE LAW vs PROCEDURAL LAW

Substantive Law Procedural Law
Rights/liabilities बताता है Rights/liabilities enforce करने की प्रक्रिया बताता है
WHAT HOW
Legal entitlement/offence Court process/procedure

CLAT Memory Trick

Substantive = WHAT

Procedural = HOW

1.23 DOMESTIC OR MUNICIPAL LAW

Example

Memory

Domestic = Within the country

1.24 INTERNATIONAL LAW

Examples

  • Treaties
  • International Conventions
  • Diplomatic Rules
  • International Disputes

Memory

International Law → Beyond one country’s internal legal system

1.25 PUBLIC INTERNATIONAL LAW

Examples:

  • Treaties
  • Diplomatic relations
  • International disputes
  • State responsibility

1.26 PRIVATE INTERNATIONAL LAW

Private International Law तब relevant होता है जब private dispute में more than one country का connection हो।

Questions

  • Foreign judgment recognise

Easy Formula

Public International Law → International public relationships

Private International Law → Private dispute + foreign connection

1.27 SOURCES OF LAW

Source of Law

Major sources:

  1. Constitution
  2. Legislation
  3. Custom
  4. Judicial Precedent
  5. Delegated Legislation
  6. International Treaties and Conventions
  7. Juristic Writings

1.28 CUSTOM AS A SOURCE OF LAW

Important Point

1.29 ESSENTIALS OF A VALID CUSTOM

1. Antiquity

Custom sufficiently old और established होना चाहिए, subject to the applicable legal context.

2. Continuity

3. Peaceful Enjoyment

4. Certainty

5. Reasonableness

6. Consistency with Law

7. Acceptance

CLAT Trap

Duration alone sufficient

1.30 TYPES OF CUSTOM

General Custom

Local Custom

Legal Custom

Customary Usage

1.31 LEGISLATION AS A SOURCE OF LAW

  • Parliament
  • State Legislatures

Important Terms

Legislature = Law-making body

Legislation = Law-making process/product

Example

1.32 DELEGATED LEGISLATION

Delegated Legislation

  • Rules
  • Regulations
  • Bye-laws
  • Orders

Important CLAT Point

  • Parent Act
  • Constitution

1.33 JUDICIAL PRECEDENT

Definition

Precedent = Previous judicial decision used as authority or guidance in later cases.

Easy Memory

Precedent = Previous Judgment

1.34 RATIO DECIDENDI

Ratio Decidendi

Simple Example

Memory Trick

RATIO = REASON

Ratio Decidendi = Reason for the Decision

1.35 OBITER DICTA

Obiter Dicta

Memory Trick

Obiter = Remarks made in passing

Ratio vs Obiter

Ratio Decidendi → Necessary legal principle

Obiter Dicta → Incidental observation

1.36 BINDING PRECEDENT

Important Point

1.37 PERSUASIVE PRECEDENT

Memory

Binding = Follow

Persuasive = Influence

1.38 CONSTITUTION AS A SOURCE OF LAW

  • State institutions की powers define करता है
  • Fundamental Rights provide करता है
  • Government structure establish
  • Constitutional limitations

CLAT Memory

Constitution = Supreme Legal Framework

1.39 INTERNATIONAL TREATIES AND CONVENTIONS

International treaties और conventions international legal relations में important role play करते हैं।

Examples:

  • Human Rights Conventions
  • Environmental Conventions
  • Diplomatic Conventions
  • International Agreements

“Every international treaty automatically becomes domestic law.”

1.40 JURISTIC WRITINGS

इनका value generally persuasive या explanatory हो सकता है, depending on the legal context.

1.41 CUSTOM vs LEGISLATION vs PRECEDENT

Basis Custom Legislation Judicial Precedent
Origin Social Practice Legislature Courts
Formation Gradual Formal Judicial Decision
Written May be unwritten Generally written Written judgment
Key Idea Practice Statute/Act Previous decision
Memory People Practice Legislature Previous Judgment

Super Memory Trick

CUSTOM → PEOPLE PRACTICE

LEGISLATION → LEGISLATURE

PRECEDENT → PREVIOUS JUDGMENT

1.42 LAW AND JUSTICE

Law

Legally recognised rules का system.

Justice

Golden Rule

Given Legal Principle > Personal Opinion

1.43 LAW AND RIGHTS

Right generally किसी व्यक्ति का legally recognised claim, liberty, power या interest हो सकता है।

Example

A के पास किसी property पर valid legal right है।

ऐसी स्थिति में law A के right और B की corresponding duty को recognise कर सकता है।

1.44 LAW AND DUTY

Duty

Basic Relationship

Right ↔ Duty

1.45 PRINCIPLE-BASED LEGAL REASONING

1. PRINCIPLE

Legal rule

2. FACTS

3. QUESTION

1.46 MASTER FORMULA

P → F → A → C

P = Principle पढ़ो

F = Facts identify करो

A = Apply the Principle

C = Conclusion चुनो

Principle

General legal rule.

Example:

A person who intentionally takes another person’s property without consent may be liable for theft.

Facts

Specific situation.

Example:

A takes B’s phone without B’s permission and keeps it.

Application

Conclusion

Golden Rule

Given Principle > Personal Assumption

1.49 IRRELEVANT FACTS

Example:

  • Phone
  • Permission
  • Intention
  • Given principle

Exam Tip

“A entered B’s house.”

Additional facts

  • Given principle

Golden Rule

1.51 MAY, MUST और SHALL

MAY

MUST

SHALL

Exam Tip

1.52 “ONLY IF” और “IF” का TRAP

IF

ONLY IF

Example

A can enter only if he has permission.

Permission = Necessary Condition

Context important है।

1.53 NECESSARY और SUFFICIENT CONDITION

Necessary Condition

Example

Sufficient Condition

CLAT Tip

Necessary ≠ Sufficient

1.54 COMMON CLAT TRAPS

Trap 1

Law = Morality

Wrong.

Trap 2

Every Custom = Law

Wrong.

Trap 3

Every Previous Judgment = Binding Precedent

Wrong.

Trap 4

Every Breach of Contract = Crime

Wrong.

Trap 5

Every Social Rule = Legal Rule

Wrong.

Trap 6

Scientific Law = Legal Law

Wrong.

Trap 7

Personal Opinion = Legal Answer

Wrong.

Trap 8

Longest Option = Correct Answer

Wrong.

1.55 HIGH-YIELD DIFFERENCES

LAW vs MORALITY

Law → Legally enforceable rules

Morality → Ethical standards

CIVIL vs CRIMINAL LAW

Civil → Rights, Disputes, Remedies

Criminal → Offences, Punishment

PUBLIC vs PRIVATE LAW

Public → State/Public Power

Private → Private Relationships

SUBSTANTIVE vs PROCEDURAL LAW

Substantive → WHAT

Procedural → HOW

CUSTOM vs LEGISLATION

Custom → Practice

Legislation → Formal Law-making

RATIO DECIDENDI vs OBITER DICTA

Ratio → Necessary Legal Reasoning

Obiter → Incidental Remarks

DE FACTO vs DE JURE

De facto → In Fact

De jure → By Law

1.56 CLAT QUESTION SOLVING STRATEGY

अगर Question Definition-Based है

Keyword → Concept → Definition → Option

अगर Question Classification-Based है

Category → Characteristics → Example → Option

अगर Question Source-Based है

Source → Origin → Legal Role → Option

अगर Question Principle-Based है

Principle → Relevant Facts → Application → Conclusion

अगर Question Assertion–Reason है

Assertion

Reason

CHAPTER 1 — MASTER TAKEAWAY

  1. Law = Legally recognised and enforceable rules.
  2. Law society में order, rights, duties और dispute resolution maintain करने में important है।
  3. Austin → Command + Sovereign + Sanction.
  5. Civil Law → Rights/Disputes; Criminal Law → Offences/Punishment.
  6. Public Law → State/Public Power; Private Law → Private Relationships.
  7. Substantive Law → WHAT; Procedural Law → HOW.
  8. Major Sources → Constitution, Legislation, Custom, Precedent
  9. Ratio Decidendi → Necessary Legal Principle; Obiter Dicta → Incidental Observation.
  10. CLAT Legal Reasoning → Principle → Facts → Application → Conclusion.

FINAL CLAT MANTRA

यही Legal Aptitude की सबसे important skill है और यही आगे के Criminal Law, Contract Law, Acts और Law of Tort chapters की foundation बनेगी।
