CHAPTER 4 — IMPORTANT ACTS
CLAT LEGAL APTITUDE CRASH COURSE
CLAT Aspirants | B.Tech Students | Non-Law Background Students
CHAPTER INTRODUCTION
अगर आप CLAT Legal Aptitude पहली बार पढ़ रहे हैं, तो सबसे पहले यह समझना जरूरी है कि Act क्या होता है?
कई students को सीधे यह बता दिया जाता है कि:
“Negotiable Instruments Act cheque से related है।”
लेकिन अगर student को यह ही नहीं पता कि Act क्या है, Negotiable Instrument क्या है, और Cheque किस तरह का instrument है, तो वह concept को कैसे समझेगा?
इसलिए इस chapter में हम हर important Act को केवल नाम से नहीं पढ़ेंगे।
हम समझेंगे:
- Act क्या होता है?
- Act की जरूरत क्यों पड़ती है?
- Act किस problem को solve करता है?
- उस Act का simple Hindi meaning क्या है?
- उसमें कौन-से important legal concepts हैं?
- CLAT में उस Act से question किस तरह बन सकता है?
- Principle + Facts को कैसे apply करना है?
इस chapter का उद्देश्य आपको lawyer बनाना नहीं है।
इसका उद्देश्य है कि CLAT Legal Reasoning में जब आपको किसी Act का नाम, principle या situation मिले, तो आपको तुरंत समझ आ जाए:
“यह कानून किस चीज के बारे में है और इसमें legal issue क्या है?”
1. ACT क्या होता है?
सबसे पहले सबसे basic concept समझिए।
Act की आसान परिभाषा
Act एक ऐसा written law है जिसे Legislature द्वारा बनाया और formally enacted किया जाता है ताकि किसी particular subject, right, duty, offence, procedure या social problem को regulate किया जा सके।
सरल Hindi में:
Act = किसी खास विषय के लिए बनाया गया कानून।
उदाहरण के लिए:
अगर सरकार को cheque से जुड़े legal rules को व्यवस्थित करना है, तो उसके लिए एक specific law हो सकता है।
अगर property transfer के rules को regulate करना है, तो उसके लिए अलग law हो सकता है।
अगर consumers को protection देना है, तो उसके लिए अलग law बनाया जाता है।
इसी तरह अलग-अलग problems और subjects के लिए अलग-अलग Acts बनाए जाते हैं।
2. ACT की जरूरत क्यों पड़ती है?
समाज में बहुत सारे अलग-अलग areas होते हैं:
- Property
- Business
- Marriage
- Education
- Consumer Rights
- Employment
- Cyber Crime
- Wildlife
- Evidence
- Banking Transactions
इन सभी के लिए एक ही general rule पर्याप्त नहीं हो सकता।
इसलिए Legislature specific subjects के लिए detailed laws बनाती है।
Example
अगर कोई व्यक्ति किसी दूसरे से property खरीदता है, तो सवाल होंगे:
- Property कैसे transfer होगी?
- Sale क्या है?
- Mortgage क्या है?
- Gift क्या है?
- Lease क्या है?
इन questions के लिए property law की जरूरत होती है।
इसी तरह:
अगर किसी व्यक्ति ने cheque दिया और cheque dishonour हो गया, तो अलग legal rules लागू होंगे।
3. ACT और LAW में क्या अंतर है?
Simple level पर समझिए:
Law एक broad term है।
Act law का एक important statutory form है।
उदाहरण:
“Property Law” एक broad area है।
इसके अंदर property से संबंधित specific Acts और judicial rules हो सकते हैं।
Easy Memory
LAW = बड़ा concept
ACT = Legislature द्वारा बनाया गया specific written law
4. ACT को ऐसे समझिए
मान लीजिए आपके college में अलग-अलग चीजों के लिए अलग-अलग rule books हैं।
एक rule book:
Examination Rules
दूसरी:
Attendance Rules
तीसरी:
Discipline Rules
उसी तरह legal system में भी अलग-अलग subjects के लिए अलग-अलग laws होते हैं।
इसलिए:
Act = किसी specific legal subject के लिए बनाई गई statutory rulebook.
लेकिन ध्यान रखें:
Act केवल “rules की list” नहीं है।
यह legally enforceable statutory framework होता है।
5. LEGISLATURE क्या होती है?
Act को समझने के लिए Legislature समझना भी जरूरी है।
Legislature वह constitutional law-making body है जो laws बनाती है।
भारत में Parliament और State Legislatures अपने respective constitutional powers के अनुसार laws बनाती हैं।
जब Legislature किसी Bill को निर्धारित constitutional process के अनुसार pass करती है और वह law बन जाता है, तो वह Act के रूप में लागू हो सकता है।
Simple Formula
Bill → Legislative Process → Law/Act
6. ACT में क्या-क्या हो सकता है?
किसी Act में अलग-अलग चीजें दी जा सकती हैं:
- Definitions
- Rights
- Duties
- Powers
- Restrictions
- Prohibitions
- Procedures
- Penalties
- Exceptions
- Remedies
- Authorities
- Appeals
- Enforcement mechanism
इसलिए CLAT में किसी Act का नाम याद करना काफी नहीं है।
आपको यह समझना है:
Act किस problem को regulate करता है?
7. CLAT में ACTS क्यों पढ़ाए जाते हैं?
CLAT Legal Reasoning में आपको कई बार passage में एक legal principle दिया जाता है।
उदाहरण:
“Under a particular law, a protected animal cannot be hunted unless statutory permission exists.”
फिर facts दिए जाते हैं:
“A ने protected animal का hunting किया और उसके पास permission नहीं थी।”
अब आपको करना है:
Principle → Facts → Application → Conclusion
यानी Act का पूरा section याद करने से ज्यादा जरूरी है कि आप उसका principle समझें और facts पर apply करें।
8. ACTS पढ़ने का MASTER FORMULA
हर Act को इन 5 चीजों से पढ़िए:
1. ACT का नाम
कौन-सा कानून?
2. ACT का PURPOSE
यह कानून क्यों बनाया गया?
3. ACT का SIMPLE MEANING
आसान Hindi में यह किस चीज से related है?
4. KEY CONCEPTS
इसमें कौन-से important words हैं?
5. CLAT APPLICATION
अगर facts दिए जाएं तो इसे कैसे apply करेंगे?
Formula:
ACT → PURPOSE → MEANING → KEY CONCEPT → APPLICATION
PART A — IMPORTANT ACTS
9. INDIAN EVIDENCE ACT, 1872
यह Act क्या है?
Evidence का मतलब है साक्ष्य या प्रमाण।
Court में जब किसी case की सुनवाई होती है, तो केवल यह कहना पर्याप्त नहीं होता कि:
“मैं सही हूँ।”
Court को facts establish करने के लिए legally relevant material चाहिए।
यही वह area है जिसे evidence law regulate करता है।
आसान भाषा में:
Evidence Law यह बताता है कि court किसी case को decide करते समय किन facts, statements, documents और other evidence को consider कर सकती है और किन conditions में कर सकती है।
10. EVIDENCE का SIMPLE EXAMPLE
A पर चोरी करने का आरोप है।
A कहता है:
“मैं चोरी के समय उस जगह पर था ही नहीं।”
अब court के सामने questions हो सकते हैं:
- CCTV footage relevant है?
- किसी witness का statement relevant है?
- कोई document relevant है?
- कोई statement admissible है?
- कौन-सी evidence legally स्वीकार की जा सकती है?
यही evidence law का basic area है।
11. RELEVANCE क्या है?
Relevance = किसी fact का case के issue से logical connection होना।
Example
A पर B की car चोरी करने का आरोप है।
A के पास चोरी के समय उस car की key थी।
यह fact relevant हो सकता है क्योंकि इसका case से connection है।
लेकिन:
A को कौन-सा खाना पसंद है?
यह सामान्यतः चोरी के issue से relevant नहीं होगा।
Memory
RELEVANCE = CASE से CONNECTION
12. ADMISSIBILITY क्या है?
Admissibility = क्या law उस evidence को court में legally accept करने की अनुमति देता है?
यह बहुत important distinction है।
Relevance
“क्या इसका case से connection है?”
Admissibility
“क्या law इसे court में स्वीकार करने देता है?”
Memory
RELEVANCE = CONNECTION
ADMISSIBILITY = LEGAL ACCEPTANCE
13. ADMISSION क्या है?
Admission generally ऐसा statement है जो किसी relevant fact या issue के बारे में किसी party की position को support कर सकता है।
Example
A और B के बीच ₹1 lakh का dispute है।
A कहता है:
“हाँ, मैंने B से ₹1 lakh उधार लिए थे।”
यह statement relevant circumstances में admission हो सकता है।
14. CONFESSION क्या है?
Confession criminal context में ऐसा statement होता है जिसमें accused अपने द्वारा offence किए जाने को admit करता है, subject to applicable evidence law.
Example
A पर robbery का आरोप है।
A कहता है:
“हाँ, मैंने ही robbery की थी।”
यह confession के concept से जुड़ सकता है।
Important Difference
Admission broader concept है।
Confession criminal guilt से संबंधित specific concept है।
Memory
ADMISSION = Relevant Acceptance/Statement
CONFESSION = Criminal Guilt की Admission
15. EVIDENCE ACT — CLAT APPROACH
Evidence question में पूछिए:
- Fact क्या है?
- यह किस issue से connected है?
- Statement किसने दिया?
- किस situation में दिया?
- क्या यह relevant है?
- क्या यह admissible है?
Formula:
FACT → RELEVANCE → ADMISSIBILITY → CONCLUSION
16. NEGOTIABLE INSTRUMENTS ACT, 1881
अब एक ऐसा Act देखते हैं जिसे students अक्सर केवल “Cheque वाला Act” समझ लेते हैं।
लेकिन पहले समझिए:
NEGOTIABLE INSTRUMENT क्या होता है?

- Cheque
17. PROMISSORY NOTE क्या है?
Promissory Note = लिखित promise to pay.
एक व्यक्ति लिखित रूप से promise करता है कि वह दूसरे व्यक्ति को निश्चित राशि देगा।
Example

“मैं B को ₹50,000 देने का वचन देता हूँ।”
यह promissory note के concept से related हो सकता है, subject to statutory requirements.
Memory
PROMISSORY NOTE = PROMISE TO PAY
18. BILL OF EXCHANGE क्या है?
Bill of Exchange में एक व्यक्ति दूसरे व्यक्ति को निर्देश देता है कि वह किसी तीसरे व्यक्ति को या specified person को निश्चित amount pay करे, subject to legal requirements.
Memory

Example
A के bank account में ₹1 lakh है।
A B को ₹20,000 का cheque देता है।
B cheque bank में present करता है।
Bank applicable conditions के अनुसार payment process करता है।
20. CHEQUE BOUNCE / DISHONOUR
अगर cheque properly presented होने के बाद payment नहीं होती और statutory conditions satisfy होती हैं, तो dishonour of cheque का legal issue arise हो सकता है।
Important
सिर्फ इतना जानना:
“Cheque bounce = crime”
काफी नहीं है।
देखना होगा:
- Cheque क्यों dishonour हुआ?
- Statutory conditions क्या हैं?
- Notice की requirement है?
- Time limit क्या है?
- Payment बाद में हुई या नहीं?
- Given principle क्या कहता है?
21. NEGOTIABLE INSTRUMENTS ACT को ऐसे याद करें

89. CLAT में ACT का QUESTION कैसे आएगा?
अब सबसे important part।
CLAT में आपसे हमेशा यह नहीं पूछा जाएगा:
“Negotiable Instruments Act किस year में बना?”
इसके बजाय आपको एक principle और facts दिए जा सकते हैं।
Example
PRINCIPLE
A cheque-related statutory offence arises only when prescribed legal conditions are satisfied.
FACTS
A ने B को cheque दिया।
Cheque dishonour हुआ।
B ने required statutory procedure follow किए बिना A को immediately liable मान लिया।
QUESTION
क्या A automatically liable है?
अब आपको सोचना है:
Cheque → Negotiable Instrument → Statutory Conditions → Facts
यही CLAT Legal Reasoning है।
90. PRINCIPLE–FACTS–APPLICATION METHOD
हर Act-based question में:
STEP 1 — PRINCIPLE पढ़ें
Law क्या कह रहा है?
STEP 2 — FACTS पढ़ें
Actual situation क्या है?
STEP 3 — KEYWORDS खोजें
क्या facts में वही conditions हैं?
STEP 4 — MATCH करें
Principle की conditions facts में पूरी हो रही हैं?
STEP 5 — CONCLUSION
कौन-सा option principle को सबसे accurately apply करता है?
91. ACT-BASED QUESTION का MASTER FORMULA
